Following a hearing of the Health Committee into a complaint made against a pharmacist which took place on 25th May 2021 and 6th May 2022, the Council of the PSI considered the report of the Health Committee on 15th December 2022 and decided to cancel the registration of the pharmacist. Pursuant to section 57(1) of the Pharmacy Act 2007, the Council is obliged to give public notice of the sanction of cancellation, however in circumstances where the inquiry before the Health Committee was conducted in private and concerned with the medical condition of the pharmacist, the Council decided that such publication be anonymised as regards the identity of the pharmacist.
The Council also decided pursuant to section 57(2) of the Pharmacy Act 2007 that it was in the public interest to publish the Committee report, but for the same reasons as set out above, imposed the same requirement regarding the anonymity of the pharmacist in the report.
Pursuant to section 52 of the Pharmacy Act 2007, the High Court confirmed the Council’s decision on 23rd March 2023.
