A pharmacy (anonymous)

Following a hearing of the Health Committee into a complaint made against a pharmacy which took place on 18 & 19 September 2023, the Council of the Pharmaceutical Society of Ireland (the “Council”) considered the report of the Health Committee on 25 January 2024 and decided to censure the pharmacy pursuant to section 48(1)(b)(i) of the Pharmacy Act 2007 (the “Act”) and to impose a condition pursuant to section 48(1)(b)(ii) of the Act, to the pharmacy’s registration. The Council also decided to publish the report of the Health Committee in accordance with the provisions of section 57(2) of the Act. The Council’s decision was subsequently confirmed by the High Court on 22 April 2024.

Under sections 57(1)(e) and 57(1)(h) of the Act respectively, the Council is obliged to give public notice of the sanctions of censure and the attachment of conditions to a registration however the Council decided the identity of the pharmacy shall be anonymised in so doing.

The Council also decided that it was in the public interest to publish the report of the Health Committee but redacted so as to anonymise the pharmacy.

The Council’s decision was subsequently confirmed by the High Court on 22 April 2024.
